A 72-year-old man is filing suit against Kroger after he says a store manager attacked him.

John Young says he was left physically and emotionally scarred after the violent confrontation at a Union City Kroger.

Young said that he suffered a gash to the head and injured his arm after Kroger manager Jack Hinesley accused him of selling food in the store parking lot and threw him to the ground.

Young runs the charity God's Goodness and distributes food donated by area businesses to the needy.  The 72-year-old man says he was shopping at the store and overheard someone saying they didn't have enough money for food. He said that he started giving away food in the parking lot and was confronted by a security guard and the store manager.

"The manager and security came out said, ‘Get off the property, you're selling food.' I said, ‘I'm not selling food.' The people there said the same thing," said Young.

Young says Hinesley demanded proof and when he handed over the paperwork, he says the store manager refused to give it back.

"I said, ‘Don't go away with my stuff,' and he turned around and grabbed me to the ground with my shoulder," said Young.

Hinesley was arrested and charged with assault and battery.

Kroger launched an investigation and issued this statement earlier on Friday saying,"What happened to Mr. Young was a terrible thing. This never should have happened and we deeply regret that it did. After an internal investigation, we have decided to terminate Mr. Hinesley's employment with Kroger. We hope Mr. Young recovers quickly from the injuries he suffered."

Young said he's never met the store manager but that he is well-known in the area. He says he's shopped at the store for years and knows several of the employees.  His daughter also used to work here.

Young's lawyers say they're interviewing witnesses, gathering evidence, and plan to file suit soon.  They're demanding an apology and monetary compensation.
