Man arrested in rape of Manhattan college student

Police say a Manhattan college student was raped and sodomized by man who waited nearby as she returned to her apartment on September 28.

Detectives finally caught 33-year-old Juan Martinez of Elmhurst, Queens on Monday, November 26 and charged him with first-degree rape and committing a criminal sexual act.

The sexual assault happened back in September around 4:00 a.m. when the 29-year-old victim returned home to her apartment on West 15th Street in Chelsea after a night of partying.

When she tried to open her door Martinez allegedly jumped out from a dark corner and grabbed her. He then forced his way inside her apartment and threw her down and the 5-foot-7; 205-pound Martinez raped her.

Authorities said Martinez is being held on $5,000 bail at Rikers Island and faces up to 25 years in prison if convicted on the top charge of rape.

The New York Post says according to the city's Department of Correction Web site, the Mexican-born Martinez is wanted on an immigration warrant.
