On Monday FOX 4 reported on a story of a lawsuit over a nativity display in Athens, southeast of Dallas. The display is on the grounds of the Henderson County courthouse.
Patrick Greene is a San Antonio atheist who is suing the city of Athens over the nativity display.
His lawsuit claims the city of Athens is promoting Christianity over other religions. The lawsuit also claims the city is helping fund the display, which he says is a violation of both state and federal law.
The original story said that Greene has been suing over nativity scenes for decades all over the country. In fact, there is evidence of only two such lawsuits including one in 1998 in Ontario, Calif. and the one in Athens.
In addition, FOX 4 stated that Greene did not return phone calls or emails. In fact, the one email that was sent apparently got caught in his spam filter and the phone number called was incorrect. The station apologizes for the inaccuracies.
Greene said he would have been happy to speak to a reporter. He also said he is not suing for money or publicity, but because he wants the city of Athens to abide by the law.
Greene said if the city moved the nativity scene to a church property, there would be nothing illegal about it.
