A former bus monitor for Dallas County Schools has sued that transportation company.
Paul Green was fired in September of last year for urinating on himself on a school bus. He's since filed a lawsuit claiming disability discrimination.
Green has suffered from colon cancer, hypertension and congestive heart failure. But he said in all the years he's work with his medical conditions he's never had a bus driver who wouldn't stop and allow him to use the restroom when his medicine made him have to go.
"The way you treat that is with diuretics. Remove that fluid and one of the medications that he took caused him to have on occasion the urgent need to go," said Attorney Matthew Scott.
Green said he repeatedly asked the driver to stop the bus so he could go, but he wouldn't.
"We rode through four lights and I asked him. I said, 'Carlos, I have to use the bathroom.' I told him I had because I had already urinated on myself and I was embarrassed. Not only embarrassed, but I was kind of tore up about it," he said.
There were no students on board at the time.
According to his dismissal letter from Dallas County Schools, Green was fired in part because he engaged in unprofessional conduct while on a bus and because he failed to protect the health and safety of the students from exposure to body fluids.
The bus driver was given a one day suspension.
"A day paid vacation is what it boils down to and Mr. Green got fired. That's a tough one. I think that's gonna be a very tough thing for them to sell to the people at large," Scott said.
Green has been out of work since then and he said he's had to pawn his belongings.
"I wasn't able to get them out of the pawn shop, but I had to eat. I had to live. I had to get my medication and that was the hard part, getting my medication," he said.
Dallas County Schools would not comment because of pending litigation. In a response it filed to Green's lawsuit denied all of the claims.
Depositions of other bus drivers who have worked with Green in the past begin this week.
