Bridgeview paving company seeks to have Target lawsuit dismissed

A Bridgeview paving company being sued by the Target Corp. for alleged fraud plans will ask a judge in May to dismiss the lawsuit after settlement talks between the companies broke down this week.
Target filed a federal lawsuit in August claiming that Bridgeview-based Rose Paving and other contractors defrauded the retailer by fixing prices and failing to adequately complete parking lot projects at various stores nationwide.
Rose Paving attorneys and officials planned to discuss a settlement with Target and a judge this week in U.S. District Court in Minneapolis, but company founder Alan Rose wrote in an email to the SouthtownStar on Wednesday that no agreement was reached. He said Rose's attorneys will ask the judge to dismiss Target's complaints on the next court date, May 16.
"We and our attorneys strongly dispute the claims against Rose Paving," Rose wrote. "Rose Paving submitted competitive bids and provided Target with high-quality parking lot repairs that were consistent with its contract and instructions received from Target's agent."
Target paid Rose Paving about $2.3 million for the work that it claims was not properly completed, according to the lawsuit.
