NEW YORK (MYFOXNY) -

A man described as a household employee of the Putnam County District Attorney is facing rape charges.

Alexandru Hossu is an undocumented worker from Romania who had been prosecutor Adam Levy's live-in personal trainer.

Hossu is accused of raping a 12-year-old girl more than two years ago.  Authorities claim that Hossu raped the girl two times on the same day in October 2010.

Levy has recused himself from the case, citing a personal conflict.  The district attorney of a neighboring county is expected to prosecute the case.

Levy is the son of TV personality Judge Judy Sheindlin.  He was elected in 2007.  The alleged crime did not take place at Levy's home and did not involve any members of his family.

Hossu is being held at the Putnam Correction Center.  He could face 25 years in prison if convicted.

The Putnam county sheriff said Hossu is in the United States on an expired work visa.
