NJ high court: DEP OK to fine Hunterdon couple

TRENTON, N.J. (AP) — New Jersey's Supreme Court says the state Environmental Protection Department was justified in fining a Hunterdon County couple for altering part of their property that was on protected wetlands.

Robert and Michelle Huber bought the property in Clinton in 1999. Acting on a complaint from a neighbor that the Hubers had placed fill on protected land, a DEP representative conducted a search of the property in 2002.

The agency fined the Hubers $4,500 and ordered them to return the land to its former condition.

The Hubers claimed the DEP searched their property without a required warrant or their consent.

In Thursday's opinion, the court cast doubt on the search but said even without it, there was ample evidence the Hubers violated environmental regulations.
