Reese Witherspoon, husband arrested in Atlanta

Reese Witherspoon says she's "deeply embarrassed" about her arrest on disorderly conduct charges last Friday morning in Atlanta.  The 37-year-old Oscar-winning actress wound up in jail after she and her husband were pulled over early Friday morning in Buckhead.  

According to a Georgia State Patrol incident report, police arrested Witherspoon and husband Jim Toth just after midnight on Friday.  The report says police pulled the couple over on Peachtree Road Northeast.  A GSP trooper reported the car they were driving in was weaving across the double yellow line.  The incident report says Toth was behind the wheel, and he pulled into a Walgreens Pharmacy parking lot, where he failed a sobriety test.  

The report says Toth, 42, had droopy eyelids and watery, bloodshot eyes, and that his breath smelled strongly of alcohol.  Toth told the trooper he had had a drink, which Witherspoon said was consumed at a restaurant two hours earlier.  

The report describes how as Toth was arrested, Witherspoon got out of the car and told the officer, "I am a U.S. citizen," and that she was "allowed to stand on American ground."  The trooper who filed the report said she refused to stay in the car despite being told to do so several times, and she was warned that if she didn't stay in the car, he would arrest her.  

When the trooper arrested her, Witherspoon pulled a celebrity card-- which didn't work.  The incident report says she asked the trooper, "Do you know my name?"  The trooper says he told her he didn't need to know who she was.  The report says Witherspoon then said, "You're about to find out who I am," and later told the trooper, "You're about to be on national news."

Both Witherspoon and Toth were taken to jail.  They were released several hours later.  Toth was charged with driving under the influence and failure to maintain the lane, while Witherspoon was charged with disorderly conduct.  A hearing in the case was scheduled for Monday morning, but neither Witherspoon nor her husband appeared.

Witherspoon appeared on the red carpet at a movie premiere in New York on Sunday, but did not address the arrest.

Witherspoon released the following statement about the incident through her attorney:


"Out of respect for the ongoing legal situation, I cannot comment on everything that is being reported right now. But I do want to say I clearly had one drink too many and I am deeply embarrassed about the things I said. It was definitely a scary situation and I was frightened for my husband, but that was no excuse. I was disrespectful to the officer who was just doing his job. I have nothing but respect for the police and I am very sorry for my behavior.
