PHOENIX -

There are major developments surrounding the death of a Phoenix Police officer killed by a hit-and-run driver. The owner of the SUV that allegedly hit the officer has been arrested.

But right now he's only facing drug charges. Why?

Police pulled Jesus Molina over hours after the collision. He was driving that same SUV. But right now officers can't prove he was the one behind the wheel when Officer Daryl Raetz was hit.

So Molina is in jail without bond on only a drug charge.

Monday, Phoenix Police released pictures of the SUV that hit and killed Officer Daryl Raetz. The front grill and hood are dented. Police are now trying to determine if he was driving the SUV.

"It's unbelievable. Anybody who knows Daryl will tell you the same thing that I tell you here, the guy was a magnet, he knew how to find bad guys," says Det. Jeff Clement, Officer Raetz's best friend.

Det. Clement says the driver who killed his best friend needs to come forward and take responsibility.

"Daryl deserves that, his family deserves that, the community deserves that. We need that type of closure."

24-year-old Jesus Molina is the registered owner of the SUV. Surprise Police pulled him over on Sunday afternoon. Molina's dad told officers his son is the only one who would drive the SUV. Still, Molina hasn't confessed to being the one behind the wheel when Officer Raetz was killed.

Police say he did have a baggie of cocaine on him, so he's being held on a drug charge for now.

"I'm also finding probable cause that you're not legally in the United States, that's based on information provided to me by an immigration agent. As a result the law requires you be held in jail with no bond," said a judge at Molina's arraignment.

Officer Raetz became a police officer six years ago. His wife Stephanie and his 5-year-old daughter Tatum were his world.

"He was the type of guy that would work 3rd shift all night, get off at 6 Sunday morning, go coach his daughter's soccer practice for until 8 or 9 p.m., and hang out with her all day. Get a couple hours sleep and go back to work," says Det. Clement.

According to records, Molina does have a criminal record. He's has been arrested for DUI twice and once for burglary.

Police are asking that anyone who may have information or may have seen the SUV on Saturday night to call Phoenix Police.

They really need help trying to figure out who was driving.
