Boyfriend Now Charged With Murder And Kidnapping In 7 Month Old's Death

UPPER DARBY, Pa. -
Police say that 30-year-old accused killer Ummad Rushdi told a witness back in early August that he could get away with murder. The fact is he now stands charged with kidnapping and murder in the death of 7-month-old Hamza Ali.

"This is a barbaric act committed by a barbarian," said Upper Darby Police Superintendent Michael Chitwood. "Rushdi is a barbarian."

Rushdi was charged on Tuesday with the August 4th murder of the baby inside his home on the 6600 block of Chestnut Street in Upper Darby, after an exhaustive three week search for the baby's body both in Upper Darby and in York, Pennsylvania.

"I don't believe we ever will find that baby," Chitwood told reporters. "We will continue looking for that baby. This is a quote. The baby can't be retrieved...Quote from Rushdi, 'the baby can't be retrieved.'"

Investigators now say that Rushdi admitted to shaking the baby to death and burying the child. Court papers say he told a witness the day before the murder that he wanted to get rid of the baby. "I will throw him off a bridge," he allegedly said. "I can get away with murder."

"He hated the baby, based on everything we got," Chitwood said. "He just did not like the baby. The baby interfered with his life."

Detectives searched the Rushdi family home, they searched Cobbs Creek Park, they searched the neighborhood near Powell Lane and a nearby cemetery, but never found the baby's body. Rushdi even told detectives, "When I get out of jail, I'm going to dig him up and I'm going to bury him in my backyard."  

Asked about whether he thinks Rushdi should get the death penalty, Chitwood said, "The death penalty, if the DA finally decides to go for it, I support it 100 percent."

This is a potential death penalty case because of several aggravating factors, including kidnapping. The affidavit of probable cause also indicates this may have been planned. Rushdi is being held without bail in the Delaware County Prison. He faces a preliminary hearing on September 9th.

Authorities have said Rushdi was on the government's "no fly" list at one point, but has since been removed.

Several witnesses in this case are now in protective custody, including the baby's mother.

Rushdi's attorney did not return a call from FOX 29.
