Source: Ingham County Judge postpones state certification of Detroit primary election

A lawsuit brought by a candidate to become Detroit's next city clerk has a judge in Ingham County putting the brakes on the state certification of Detroit's primary election.

Fox 2 has learned that D. Etta Wilcoxen has filed a lawsuit claiming that State of Michigan canvassers do not have the right to tabulate votes in Detroit's mayoral primary election.

A Fox 2 source says Ingham County Circuit Court Judge Joyce Draganchuck has ordered a "stay" in the tabulation of votes until cause can be shown that the canvassers have the authority to do so. A hearing is scheduled for next Tuesday, September 3rd, in Draganchuck's courtroom.

This means Detroit's votes remain uncertified until at least next Tuesday.

At the center of the controversy is whether write-in votes were properly tabulated by the Detroit City Clerk election staff.

The Wayne County Board of Canvassers refused to certify the election results because it claimed procedures using hash marks to count votes were not followed.

Detroit City Clerk Janice Winfrey, who is running for re-election against D. Etta Wilcoxen,  contests the notion that hash marks were needed for the official tabulation is incorrect.  In her words, " a five is a five whether it's a whole number or hash marks."

The Wayne County Board of Canvassers sent the ballots to the Michigan State Board of Canvassers, who were close to finishing the job, according to at least one source.
