Officer Davies Doing Better, As Suspect Torres Stands Before Judge

While officer Ed Davies still lies in a hospital bed three weeks after being shot, this morning in court we heard the first-hand account of his partner and other officers with him on the day he was shot at the corner grocery store. The suspect, 31-year-old Eric Torres, was ordered held for trial today.

Davies' partner John Bucceroni testified that he, Davies and two other officers struggled with Torres for five to 10 minutes. It seemed like an eternity.

Bucceroni described Torres as freakishly strong, and Torres would not give up, as he kept two hands on his .45 caliber Glock pistol that they all could not see. It wasn't until Bucceroni felt the barrel of the gun that he realized Torres was armed, he said. And then he felt the gun barrel and then the gun go off and bullet go through the barrel that was in his hands, shooting his partner.

And still, he says, Torres would not let go of the gun, which we learned for the first time today, jammed with the casing still in the barrel. If not for the jam, Bucceroni testified, it could have been the four of them in the hospital, if not all dead.

As he tried to get the gun away, Bucceroni testified that Torres bit him twice in the arm, clamping down like a pit bill, breaking his skin like it was a piece of steak. Inside the grocery store was little room, so the other officers never pulled their own guns out because they knew their fellow officers were all just six inches to a foot away from each other.

As two officers rushed Davies in a police car to the hospital to save his life, others testified that Torres struggled even in handcuffs all the way to another patrol car.

Commissioner Ramsey was in court with more than a hundred other officers. He told FOX 29 news that he visited Davies in the hospital yesterday when Davies finally was able to stand up and take his first three steps next to his bed since being shot. He showed me a cell phone picture that he took of Davies lying in his hospital bed, tubes still coming out of his mouth, but giving him the thumbs up.

"He still has a long way to go," says Commissioner Ramsey. "But he's getting stronger everyday."
