Excedrin Deceiving Consumers?

Trenton, New Jersey (My9NJ) - A lawsuit is pending against one of New Jersey’s largest employers, Novartis, for possibly duping consumers.

Cherry Hill resident, Kerri Yingst, realized the active ingredients in Excedrin Extra Strength and Excedrin Migraine are exactly the same, but these products are being marketed for different conditions and sold for different prices. Her issue was that the migraine medication costs more and while the dosages are different in the medication, the active ingredients are identical.

Attorney Todd Muhlstock is the lead counsel on this case and he discussed whether or not the pharmaceutical company is really doing anything illegal.

“It’s not criminally illegal, it’s morally reprehensible, but also especially in New Jersey, we have very strong consumer fraud statutes and the courts and legal system don’t tolerate people ripping people off which is all this is,” he explained.

Novartis wouldn’t comment on the case itself because it is a pending litigation. The spokeswoman did articulate that Excedrin Extra Strength and Excedrin Migraine are not considered the same because the dosages are different and they are intended for different uses.

The FDA has reviewed the products and feels the dosages should be different. In fact, when taking Excedrin Extra Strength, you should take no more than 8 tablets in a 24 hour period, but when taking Excedrin Migraine, you should take no more than 2 tablets in a 24 hour period.

Muhlstock intends to file a motion to certify the case as a national class action lawsuit.
