Man Arrested For DUI at Wendy's, With Son In Back Seat

CLEARWATER, Fla. -

A 26-year-old Largo, FL man was arrested and charged with driving under the influence and child neglect, and it all happened in the parking lot of a Wendy's.

Police say David Timothy Higgins pulled into the drive-thru to order some food, and the manager could tell he was intoxicated. The manager also noticed a 4-year-old boy in the back seat.

The manager apparently then told Higgins to pull into a parking spot and wait for his food; he instead called police. Officers showed up to the location on Missouri Avenue and say Higgins failed several sobriety tests.

He told them he had been at a Super Bowl party and consumed five beers. He said he had his son in the car because he didn't think he was that drunk.

Higgins was booked in Pinellas County jail.
