A Plano couple hopes to make history in Texas this week in defense of same-sex marriage.
Mark Phariss and his partner Victor Holmes are suing the state to change Texas law, and Wednesday in San Antonio, they will find out if their case moves forward.
There are a lot of eyes on the hearing. Some argue it's about the Tenth Amendment of the Constitution, and that the Constitution doesn't grant the federal government any authority in regards to marriage.
Others cite the Fourteenth Amendment's Equal Protection Clause.
Whatever the ruling, it is likely to trigger an appeal, which would go to the 5th US Circuit Court of Appeals in New Orleans.
