Registered sex offender accused of defaming Orono police officer

Just one day after he was arrested and charged with terroristic threats, a vocal registered sex offender is now facing defamation charge after accusing an Orono police officer of rape in a bizarrely composed e-mail.

Thomas Evenstad was arrested on Monday after a series of strange visits to the homes of Gov. Mark Dayton, Hennepin County Sheriff Rich Stanek, and the prosecutor who convicted him of rape 16 years ago. He's was charged with terroristic threats after those odd exchanges, and his legal troubles got worse just 24 hours later.

According to a criminal complaint filed Tuesday, Evenstad is now also facing two gross misdemeanor charges -- one of making a false report and another of criminal defamation. Both charges carry a maximum sentence of one year in prison and up to $3,000 in fines.

Charging documents explain that Hennepin County investigators were contacted two weeks ago to review the content of an e-mail sent by Evenstad on Feb. 24.

The e-mail in question was sent to Orono Police Chief Correy Farnick, and was titled "Dan Niccum Rapist." It read in part:

"You and your Criminal Drug Dealing Rapist Framing gun aiming at Danny Niccum would have been wise to honor the false dirty cop promise you made to me personally to keep your rapist away from me."

Dan Niccum is an officer with the Orono Police Department who once helped Richfield police execute a search warrant at Evenstad's home in Mound, Minn., prior to Evenstad's criminal sexual conduct conviction in the mid 1990s. Investigators say any accusations of rape against him are false.

The e-mail went on to say: "Now, as I told this RAPIST, I will see him again legally and I won't commit a crime or violate any law or right to take his badge and gun legally [sic] and I have your System lock him away for a decade and then move to civilly commit Danny as the Violent Sexual Predator that he is."

Prosecutors, however, disagreed with that assertion when they charged Evenstad with defamation over the electronic communication, pointing to seven separate Internet domains linked in the e-mail from Evenstad. Four of those domains identified Niccum by name, including two dubbed DanNiccumRapist.com and DannyNiccumRapist.com.

The original e-mail was preserved and provided to Mark Lanterman, chief technology officer of Computer Forensic Services. Lanterman found that GoDaddy had registered the sites, and Evenstad is listed as the registrant for each.
