CHARGES: Mother could be jailed for pond crash that killed 2 children

Although prosecutors opted against filing felony charges against the 23-year-old mother who crashed her car into a retention pond in St. Louis Park, she is now facing three misdemeanors that could put her in jail.

THE CRASH

In the early hours of a November morning, Marion Guerrido apparently lost control of the Pontiac Grand Am she was driving while on a ramp to Highway 100 north while traveling west from Highway 7.

The car, which was carrying 5 children, plunged into a water retention pond and submerged. Guerrido was able to escape and cry for help.

Neighbors called 911 and tried to rescue the children, but 25 minutes passed before the first child was rescued. The last child was rescued after 45 minutes in near-freezing water.

Tests and interviews indicate the Brooklyn Center, Minn., mother was not speeding, did not have drugs or alcohol in her system, and had not been on her cell phone; however, she only had a learner's permit at the time of the crash.

Two of the children who were in the car -- Zenavia Rennie and Alarious Coleman-Guerrido -- died as a result of the crash. The remainder have recovered.

THE CHARGES

At the end of March, prosecutors announced they had no intention of filing felony charges against Guerrido -- but they did not rule out the lesser charges filed Tuesday.

Guerrido was charged by summons with failing to fasten a child passenger restraint system, driving without insurance, and violating the requirements of her instruction permit.

The first charge is a petty misdemeanor with a maximum sentence of a $50 fine, but the other two charges are misdemeanors with possible maximum sentences of 90 days in jail, a $1,000 fine, or both for each offense.

Since Guerrido only had an instructional permit to drive, Minnesota law requires a licensed driver occupying a seat beside her whenever she was behind the wheel.
