A former Allen High School teacher's aide is out on bond after being accused of having sex with a 16-year-old student, according to an arrest warrant affidavit.
Kearney Day, 20, is charged with having an improper relationship with a student.
The student admitted to having sex with Day, but originally denied it when she first reported the relationship last month. Authorities began investigating when the student “cried out to a school principal about a relationship she was having with a teacher,” according to the affidavit.
On April 4, the student told authorities that Day spent the night in her bed with her on Valentine’s Day, but that nothing sexual had taken place between the two. She also said she considered Day her girlfriend and that if something sexual had happened, she wouldn’t tell police because she didn’t want to “ruin Day’s life.”
Investigators showed the student a picture she’d given to school officials, and the student confirmed that it had been taken on Valentine’s Day in her bed, and the person in the picture was Day.
The student said she would communicate with Day using the social media app, Kik. Her phone was taken, and investigators discovered suggestive messages from Day.
One of the messages said, “Mm I want you.” The other said, “Cause I’m about to lose my [expletive] job over this [expletive]. Keep your mouth shut about me. So much for being able to trust you to in the beginning idek if ill be able to talk to you in the hallway now cause someone’s spying on my [expletive].”
Day told authorities that she and the student’s relationship began because the student was having family problems that they talked about, and that she and the student didn’t see each other outside of school.
However, later on, Day said she’d been to the student’s home and inside of her room, and had given the student a hug and shoulder rub. Day confirmed that she was the person in the photo that the student had shown to officials.
Day also admitted to sending suggestive messages to the student on Kik, but said she and the student never had sexual contact.
Day was fired on April 4, according to an Allen ISD official.
On Wednesday, the student contacted authorities. She said she had more information to share that she hadn't disclosed before because she loved Day and had wanted to protect her.
The student said that she and Day had sex three times on Valentine’s Day and that Day slept in her bed afterward. The student described Day’s body and where she had tattoos.
