Looks Like Some Shore Towns Must Halt The Hammers

Ocean Beach 3, New Jersey (My9NJ) - Down the shore, there are dozens of properties still rebuilding after Superstorm Sandy, but now, towns like Toms River and Ocean Beach 3 have banned construction for the summer until Labor Day.

On Saturday, June 14th, residents called for a vote in the last effort to lift the ban and continue recovering. One resident in particular spoke up defending herself and the other residents who are a members of the Home Owners Association.

"I don't want those stats! I want a registered vote, yay, no, lift the ban, let us make that decision as an association and then I'll follow it!" she said.

No vote occurred and no vote was scheduled, but the construction ban stands for now. This ban has polarized the Ocean Beach residents who are fighting to get back on their feet pitting them against renters and people who are looking for a peaceful summer beach experience.

During the meeting, Pete Cullen, a member of the OB3 Grounds Committee defended this construction ban.

"There are houses that nothing was done for two months, the month of April and the month of May because builders were busy setting up other houses," he said.

Child safety, the bad conditions of OB3's dirt roads and surly contractors were also among the reasons given by various board members as to reasons why they initiated this ban, which was lifted last summer.

On the other hand, similar communities are lifting their construction bans for another summer. Board President Jack Houseworth explains why OB3 is different.

"I think that we've been viewed as taking a stand and penalizing homeowners, which is absolutely not the case. We do have processes in place in our community where people can come and talk to us about if they need a couple extra days to do this, that, or the other thing and again we've done that in the past," he said.

The meeting was also filed with references to litigation. A lawsuit was brought by three residents, including one board member. This calls for fair enforcement of club bylaws, better fiscal transparency, and clarification of the board's permit authority.

Toms River and Ocean Beach has a lot to settle before the summer is officially here.
