PHOENIX (KSAZ) - A transgendered inmate held in immigration detention in Eloy, Arizona says she was raped.

She blames Immigration & Customs Enforcement for the brutal attack because she was forced to share a cell with a man who had threatened her.

Now she wants ICE to release her, and her alleged attacker prosecuted.

Jesus Leal Gamino is 23 years-old, but she goes by the name of "Marichuy," after a female character in a Mexican soap opera.

She came to America as a 6-year-old and undocumented immigrant. She attended Cesar Chavez High School in Phoenix. But then she got caught with meth, did a year in prison, and was deported.

Marichuy was beaten in a Mexican hospital and she says it was because she is transgendered.

She went to the Douglas, Arizona port of entry and asked to come back to America.


ICE put her in its Eloy Detention Center run by CCA, Corrections Corporation of America.

Marichuy says she was placed with a cell mate who threatened her.

"The manager told me he didn't have no open cells, and he was like; you have to deal with it, and I was like; are you serious, I have to deal with it, so I left it like that," said Marichuy.

Within days, she said she was attacked in the middle of the night. "He pulled me by my hair, throws me on the floor, kicking me, slams head on the floor, I passed out."

"And when I woke up, he finally raped me, I was all bruised up," said Marichuy.

Marichuy claims that staff failed to protect her.

"They don't do nothing, they don't do nothing till something happens, that's when they act," she said.

CCA had no comment and referred FOX 10 to ICE, who says they investigate all allegations of sexual abuse and take appropriate action.

But Marichuy worries what will happen if an immigration judge sends her back to Mexico.

"Well, I am asking to stay, my family is here, nobody in Mexico. If I go back, most likely I am going to get killed," said Marichuy.

The alleged rape was referred to the Eloy Police Department for investigation.
